The Association Council

  • Role:

    to monitor the application and implementation of the Agreement and periodically review the operation of the Agreement in the light of its objectives.

  • Composition:

    Ukraine is represented in the Association Council by the members of the Cabinet of Ministers of Ukraine, the EU is represented by the members of the Council of the European Union and members of the European Commission.

What does the Association Council do?

The Association Council was established under article 461 of the Association Agreement between Ukraine and the EU. The Association Council monitors the application and implementation of the Agreement and periodically reviews the operation of the Agreement in the light of its objectives. In particular, the Association Council

  • takes binding decisions for the parties within the scope of the Agreement and makes recommendations;
  • amends the annexes to the agreement;
  • serves as a forum for the exchange of information on legislative acts of Ukraine and the European Union, as well as on measures for their implementation, introduction and compliance;
  • is a platform for political dialogue at the Ministerial level.

How does the Association Council work?

Meetings of the EU–Ukraine Association Council are held at the Ministerial level at least once a year, as well as when circumstances so require. A meeting of the Association Council takes place at the usual meeting place of the Council of the European Union.

The parties shall preside in the Council of the Association alternately for 12 months. The first period of the presidency begins on the day of the first meeting of the Association Council and ends on 31 December of the same year.

Meetings of the Association Council are convened jointly by the Secretaries of the Association Council in consultation with the Chairman of the Association Council.

The Chairman of the Association Council forms the provisional agenda for each meeting. It is sent by the Secretaries of the Association Council to the addressees not later than 15 calendar days before the meeting.

The agenda consists of items, the request for inclusion of which was received by the Chairman not later than 21 calendar days before the meeting, and approved by the Association Council at the beginning of each meeting. Any issues other than those mentioned in the provisional agenda may be included in the agenda by mutual agreement of the Parties.

The draft minutes of each meeting shall be drawn up jointly by the Secretaries of the Association Council.

The minutes on each issue of the agenda contains information about the documents provided to the Association Council; statements that a member of the Association Council proposes to add the minutes with; the issues agreed by the Parties, such as decisions made, statements agreed upon and any conclusions on specific issues.

The draft minutes is submitted to the Association Council for approval. The Association Council approves the draft minutes at its next meeting. In addition, the draft minutes may be approved in writing.

The Association Council shall take a decision and make recommendations with the general consent of the Parties and after the completion of the relevant domestic procedures. Acts of the Association Council in the sense of Article 463(1) of the Agreement shall be referred to as “Decision” or “Recommendation”.

The official languages of the Association Council are the official languages of the Parties.

As provided for in Article 463(1) of the Agreement, the Association Council has the power to make decisions that are binding on the Parties in order to achieve the mentioned objectives. The Association Council shall take the necessary measures to implement the decisions taken, including, if necessary, authorize the special bodies established under this Agreement to act on its own behalf or to delegate its powers to the Association Committee.
