Parliament adopts as a whole the draft law on integrated industrial pollution prevention and control

On July 16, 2024, the Verkhovna Rada of Ukraine adopted in the second reading and as a whole the Draft Law No. 11355 “On Integrated Industrial Pollution Prevention and Control”.
The law establishes the legal and organizational framework for the prevention, reduction and control of industrial pollution to ensure the protection of the environment and constitutional rights to a safe environment for life and health through the introduction of an integrated environmental permit.
The document defines the main requirements for an integrated environmental permit, the list of activities that require it, the issuance procedure, grounds for refusal to issue, grounds and procedure for revoking an integrated environmental permit, requirements for mandatory use of the best available technologies and methods of management, emission monitoring and control of compliance with the terms of an integrated environmental permit.
The Law will ensure the fulfillment of one of the important clauses of the Ukraine Facility Program and the requirements of Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control) and will introduce integrated approaches to permitting and control of industrial pollution based on the application of the best available technologies and management methods.
The implementation of the Law will contribute to:
- improving the state of the environment;
- reducing the impact of industrial discharges and emissions on the health of Ukrainian citizens;
- gradual transition to modern environmentally friendly green technologies;
- ensuring environmental safety and maintaining ecological balance in Ukraine;
- reducing the number of permits in the field of environmental protection;
- establishing a clear, transparent and digitalized process for obtaining an integrated environmental permit.
