Main content and commitments of Ukraine

Chapter 9 of the Association Agreement, Section “Trade and Trade-related Issues”, provides for the simplification of the procedure for the creation and commercial use of innovative products and products of creative activity in the territory of the Parties, as well as the achievement of an appropriate and effective level of security and protection of intellectual property rights.

The state of adaptation of Ukrainian legislation and cooperation with the EU

 

The following draft laws in the field of intellectual property rights protection were submitted to the Verkhovna Rada of Ukraine and the Cabinet of Ministers of Ukraine:

“On Amendments to Certain Legislative Acts of Ukraine Concerning the Acquisition, Disposal and Protection of Copyright and Related Rights”, regarding the increase of the possibilities of the subjects of intellectual property rights to protect their rights and to simplify the ways of consolidating and managing copyright law.

“On Amendments to Certain Legislative Acts of Ukraine on the Protection of Copyright and Related Rights in the Internet”, regarding the establishment of an effective and transparent mechanism for the pre-trial removal or blocking of information that infringes copyright and (or) related rights in the Internet.

“On amendments to Article 5 of the Law of Ukraine “On the distribution of copies of audiovisual works, phonograms, videograms, computer programs, databases”, regarding the improving the process of issue of control marks, the independent exercise of rights in objects of copyright and related rights by owners, control over issuance of control marks.

Discussions between Ukraine and the EU about proportionality and adequacy of the measures proposed in the draft laws to implement the requirements of the Association Agreement in terms of protecting of intellectual property rights continue.
